FMCSA to Rewrite 2008 HOS Regulation
Thursday, October 29, 2009 FMCSA has agreed to review and reconsider its HOS rule. This puts on hold the federal court challenge by the coalition of advocacy groups. The "settlement agreement" between FMCSA and Public Citizen et. al., which was filed with the court on Monday, gives FMCSA nine months to submit a Notice of Proposed Rulemaking to OMB and 21 months to issue a final rule. According to DOT, the settlement was "procedural" in nature and nothing in the agreement binds FMCSA to a particular rulemaking outcome. The current rule will remain in effect until the new round of rulemaking is completed.
